TERMS & CONDITIONS
Please read these product terms and conditions carefully as they set out the terms under which worktopshop.com makes the products available to you (“Product Terms”).

1. Prices
The prices payable for the items that you order are clearly set out in the web site. All prices are expressed inclusive of any VAT payable. The price of the items does not include the delivery charge. The worktop delivery charge is £20 for each worktop on the order, accessories are charged at £10 upto 10kg. All heavier orders are charged at £20. Prices can change and we always bring you the latest prices as quickly as possible.

2. Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible.

3. Contract
There will be no contract of any kind between you and us until payment for your goods is authorised by your bank or credit card insurer. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that payment for the goods is authorised, (and not before), a contract will be made between you and us. Authority for payment must be given at the time of the order. Payment for your order will be taken once stock availability has been confirmed. If for any reason the goods cannot be supplied then payment will be refunded in full.

4. Installation
In installing or using any goods or equipment supplied by worktopshop.com the purchaser shall observe all instructions, directions and warnings issued by worktopshop.com or the manufacturer.

5. Delivery
Upon receipt of your order we will telephone you to advise you of the delivery day, therefore when completing the online order form it is imperative that you give a telephone number where you can be contacted on or one with an answerphone facility as we cannot be held responsible for failed deliveries on the due day of delivery due to vacant premises. For orders placed before 10am Monday to Friday (excluding bank holidays) delivery will usually be the next working day subject to stock. For order placed after this time, out of office hours or on bank holidays and weekends, allow 48 hours. Delivery will be made to the address specified by you. Please note that our standard delivery of products is within mainland UK only. For deliveries to Northern Ireland, Isle of Man, Isle of Wight, Isles of Scilly and Scottish Highlands additional delivery charges may occur. We do our best to secure delivery within 48 working hours of the date of your order. The cost for delivery is £20 for each worktop on the order, on the same delivery date. Accessories are charged at £10 upto 10kg then £20 for all heavier orders. If you are not at home for a pre-arranged delivery then we reserve the right to charge you the full cost of delivery again to redeliver your order.

6. Cancellation & Returns
Where the goods have been delivered to you, you may return them for up to 48 hours from the date of delivery in line with the distance selling directive and our No Quibble guarantee. We will charge you £45 to collect the goods and to withhold your refund if any damage has occurred whilst the goods have been in your possession. This does not affect your statutory rights. Refunds can only be made by the same method used for the purchase. If for any reason you need to return an item within 48 hours of receiving the delivery, please email us using the contact form on the website advising that you wish to return the product and the reason for return. We will then organise for the goods to be collected by our courier. This is usually collected within 5-7 days and will pre-advise you of the collection date. Under the terms of the distance selling directive you as the customer have a duty of care for the product whilst it is in your possession. If products are damaged by you and subsequently returned, no refund will be made. Your statutory rights are not affected.

It is the buyer’s responsibility to check the goods for damage or wrong delivery before accepting delivery. No claim for damages or wrong delivery can be made if the carrier’s receipt is signed as goods received in good condition. Any claim for damages or wrong delivery must be made in writing within 48 hours of receipt of goods, failing which all claims shall be deemed to be waived.

If goods are faulty you may return them free of charge by emailing us using the contact form on the website advising us of the full details.

7. Payment

You can pay with any Switch, Delta, MasterCard or Visa cards. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be charged for items once stock availability has been confirmed. Our liability to you in respect of an order shall be limited to the value of that order (to the fullest extent permitted by all applicable law), and we shall not be liable to you for any economic loss, loss of profit, loss of revenue, loss of business, wasted expenditure, depletion of goodwill, loss of privacy or loss of data or any other claims for indirect, consequential, special or punitive compensation whatsoever howsoever caused including, without limitation, as a result of our negligence, which arise out of or in connection with an order. For the avoidance of doubt nothing in these terms and conditions excludes our liability in respect of death or personal injury caused by our negligence.

8. General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

All cases of force majeur such as wars, riots, strikes, lockouts, bankruptcy, fire, water damage, delay in transport, lack of means of transport, breakdown in factories or those of our suppliers or any other unforeseeable events give us the right to postpone the fulfilment of the contract, as well as to cancel it partially or wholly without thereby conferring on the Buyer the right to claim damages against worktopshop.com or the manufacturers.
